MHD’s Eyre has charges suppressed
A Jones County judge this week suppressed charges against one of the trio of men known as Motorhome Diaries.
Michael Cory, an attorney for the group, said Thursday that County Court Judge Gaylon Harper ruled in favor of one of the men’s motion to suppress charges filed against them in May 2009.
The morning of May 14, the three men were traveling in an RV on Interstate 59 North passing through Jones County when they were stopped by Jones County deputies.
Late last month, attorneys for Pete Eyre, Adam Mueller and Jason Talley sent an intent to sue letter to the Jones County Sheriff’s Department and Mississippi Highway Patrol for “unlawful conduct of their law enforcement officers” during the stop.
“(Harper) is a very fair minded judge,” Cory said. “He did rule that the traffic stop itself was significantly prolonged and granted the motion to suppress charges which the state can appeal.”
Cory said charges against Eyre of possession of beer in a dry county were suppressed, which means all evidence has been thrown out.
“A policeman can stop you for a limited purpose of addressing whatever the issue is, in this case a paper tag,” he said.
Cory noted that charges against Talley and Mueller, which police said failed to show proper identification or follow instructions, still stand.
